Indiana ban on Hemp Unconstitutional According to Federal Judge

A group of CBD retailers and advocates were granted an injuction last week, preventing the State of Indiana from enforcing IND. CODE § 15-15-13-6. SEA 516, which legalizes the commercial production of hemp in Indiana, but criminalizes the manufacture, finance, delivery, and possession of what it defines as “Smokeable Hemp”

The injuction was filed on the grounds that this verbiage is unconstitutional because of the 2018 Farm Bill or the Commerce Clause of the US Constitution, respectively.

Judge Sarah Evans Barker, United States District Court Southern District of Indiana granted the injunction on Sept 13th 2019
